The applicants have filed this application challenging the order passed by the 11th Joint Civil Judge Senior Division, Nagpur, rejecting the application filed by the applicants under Order VII, Rule 11 of the Civil Procedure Code. The partnership which was not in existence at the time of transaction between the defendant and other party, according to the applicants, the partnership firm cannot file the suit against the defendants.
