Mr. Maheshwari, learned Advocate for respondent Nos.1 and 2, states that respondent No.3 has expired. He further states that respondent No.3 is mother of respondent No.2 and that respondent No.2 is the sole legal heir of deceased respondent No.3.

In view of the aforesaid, applicant is directed to delete the name of respondent No.3 from the array of parties.

Necessary amendment be carried out forthwith. 4.

Respondent Nos.4 to 15 are the original defendants. The present Revision Application arises out of an order rejecting application for rejection of plaint filed by the present applicant, who is defendant No.1 in the said suit. The original plaintiffs are respondent Nos.1 to 3.

Learned Advocate for respondent Nos.1 and 2 states that the Civil Revision Application can be heard in

9. CRA 72.25.odt the absence of respondent Nos.4 to 15, since outcome of the revision will not adversely affect their rights. 6.

Mr. Vyawahare, learned Advocate for the applicant also states that respondent Nos.1 to 3 are the contesting respondents and that other respondents are arrayed as parties since they were parties to the civil suit. It also needs to be stated that, except for respondent Nos.5 and 11 all respondents are served by private mode. 7.

In view of the aforesaid, permission is granted to delete the names of respondent Nos.5 and 11 from the array of parties.

Put up the revision for final hearing at admission stage on 21.01.2026.
