The matter was listed today on the Production Board at the request of the Learned Advocate for the Original Appellant in this appeal filed under Section 37 of the Arbitration and Conciliation Act, 1996 ("the Act").

It is common ground among the parties that on December 22, January 5, 2026 Shraddha

501-ARA-35-2025==.doc 2025, a specific statement had been made to the Court confirming that the contract in question would not be cancelled. However, on January 3, 2026, a cancellation notice appears to have been issued by one Mr. V. P. Shrivastava, IDSE, Chief Engineer Pune Zone, asserting his right as an "accepting officer" to terminate the contract. 3.

Learned Advocate for the Respondent fairly states that, in fact, on December 22, 2025, in the presence of officers from the Respondent, a statement that no proceedings should be conducted until the next date of hearing had been made, and yet the order dated January 3, 2026 has been passed.

In these circumstances, the effect and operation of the letter dated January 3, 2026, which is at Exhibit A to the Interim Application is hereby stayed until the next date. To come up as originally scheduled on January 12, 2026.

All actions required to be taken pursuant to this order, shall be taken upon receipt of a downloaded copy as available on this Court's website.
