Learned counsel for the appellant as well as the learned counsel for the respondents submits that the contesting parties have amicably settled the controversy and the parties have filed a joint pursis dated 06.03.2026 in which the terms of compromise are stated, which is signed by the Officer of the appellant-Insurance Company and respondent No.1.

Learned counsel for the appellant as well as learned counsel for the respondents submit that the parties are personally present before the Court today and they agree to the contents of terms of settlement. 3.

In view of the terms of settlement specifically agreed between the parties, the parties are permitted to withdraw the amounts.

The appellant-insurance company is accordingly entitled for refund of Court Fees as per Rules. 5.
