Learned counsel for the appellant, on instructions, seeks permission to withdraw the appeal.

He also invites my attention to the Pursis dated 09.02.2026 along with a letter dated 29.01.2026 stating therein that the appellant desires to withdraw the appeal. 3.

In view of above, permission is granted to withdraw the appeal and accordingly, the first appeal is dismissed as withdrawn. Appellant is entitled for refund of Court Fees as per Rules.

CIVIL APPLICATION NO.3771 OF 2025 4.

The applicants/original claimants are seeking permission to withdraw the civil application with liberty to file afresh application for withdrawal of amount, if situation arises.

In view of that, civil application is disposed of as withdrawn with liberty as prayed for.
