After hearing parties for some time, when this Court has expressed disinclination to grant relief to the Applicant, learned Counsel for the Applicant, on instructions from the Applicant, seeks leave to withdraw the Civil Revision Application.

Mr. Halkude, learned Counsel for Applicant apprehends that observations of learned Trial Judge in the impugned order would cause prejudice.

Civil Revision Application is disposed of as withdrawn. 4.

It is clarified that Applicant shall be at liberty to agitate grounds, which are to be dealt with during the course of trial independently. Needless to mention that Applicant shall take recourse to the remedy as permissible in law.
