Mr. V. H. Pathade, learned Advocate would submit that he had judgment and decree in his hand for declaration of ownership that was ordered by the learned Joint Civil Judge, Junior Division, Latur on 30.09.2023 in Regular Civil Suit No.35 of 2022. Mr. Pathade, learned Advocate would submit that the defendants although were served in the Civil Suit, but did not appear in the suit to defend. As such the plaintiff/present petitioner was benefited of the judgment and order thereby decreeing his suit for declaration of title in respect of the suit property.

Mr. V. H. Pathade, learned Advocate further submits that as against the judgment and decree passed by the learned
28-cra-205-2025 Trial Court the respondent filed Regular Civil Appeal in the Court of learned District Judge, Latur. The appeal was filed by delay of 90 days. Mr. Pathade, learned Advocate would submit that the learned District Judge, Latur allowed the said application and condoned the delay of 90 days that was caused in filing the Regular Civil Appeal.

Feeling aggrieved by the order passed by the learned District Judge, Latur in Civil Miscellaneous Application (Delay) 26 of 2024, present Civil Revision Application is filed. 4.
Issue notice to the respondents returnable on 24.11.2025. Applicant is permitted to serve the respondents by all permissible modes of private service in addition to regular mode of service.

The matter be listed after service of notice is complete. In the meantime, applicant shall take recourse to the provisions enumerated in Chapter II of the Bombay High Court Appellate Side Rules, corresponding to the stage and requirement of matter.
