Heard the learned Counsel for the Applicants.

2. It is submitted by the learned Counsel for the Applicants that the Applicants have served all the Respondents in the matter by private service. He has filed an affidavit of service to that effect, which is taken on record. By the present Application, the Applicants seek to condone the delay of 92 days in filing the Second Appeal.

3. Perused the statements made in the Application and heard the learned Counsel for the Applicants. The Applicants have given the reasons in detail since 15.07.2024 for 92 days delay and have provided sufficient explanation. Therefore, the Applicants have shown sufficient 26th March, 2026

65 MCA 85 2026 cause for the delay.

4. In view thereof, the Application is allowed in terms of prayer clause (a), which reads thus:

"(a) That the Second Appeal be accepted by the Registry as filed within the limitation and/or delay of 92 days be condoned."

5. The Registry is directed to register the Second Appeal and place the same on the Admission Board on 17.04.2026.

6. MCA No. 85 of 2026 stands disposed of.
