The present Application seeks a direction for fixing a peremptory date for final hearing of the Second Appeal arising out of the Judgment and Decree dated 28.02.2013 passed by 1 / 3
the learned Ad hoc District Judge-I, North Goa at Panaji in Regular Civil Appeal No. 123/2010.

It is noted that the Second Appeal has been admitted on 10/5/2013 and is pending for final disposal. Though by order dated 17.11.2017, this Court had granted time for placing additional documents on record, the matter has not been listed thereafter. The Ld. Counsel for the Applicant has submitted that due to prolonged pendency there has been prejudice and the subsequent developments are affecting the suit property.

The Ld. Counsel for the Applicant has submitted that grave hardship and irreparable loss is being caused due to the continued stay operating against the Judgment dated 28.02.2013 and alleged acts of trespass have aggravated the situation, necessitating an expeditious adjudication. The learned Counsel appearing for the original Appellants fairly states that there is no objection to the grant of the relief sought.

Having regard to the length of pendency of the Appeal, the stage at which it stands and particularly in the facts of the case and in the interest of justice, the Application is allowed. 2 / 3

The Registry is directed to list the Second Appeal on the final hearing board in the week commencing from 27.1.2026. 7.
Application stands disposed of accordingly.
