The Applicant, who is the Petitioner in Writ Petition No.409 of 2025(Filing), has filed this application for extension of time to pay the balance decretal amount of Rs.1,19,65,375/- due to the Respondent. By an order of 16.10.2025, this Court had extended time to deposit this
amount till today, i.e. 12.11.2025, for depositing the aforesaid amount. Further extension has been sought today by tendering deposit of amount of Rs.60 lakhs through two Demand Drafts, both dated 11.11.2025, bearing numbers 500712 and 500711 drawn on ICICI Bank, Panaji, for Rs.40 lakhs and Rs.20 lakhs, respectively.

The Respondent, in principle, does not have an objection to extend time on deposit of Rs.60 lakhs with the Registry of this Court, but however, insist on the deposit of the balance payment by 30.11.2025. 5.
The aforementioned two Demand Drafts shall be deposited by the Applicant during the course of the day. Registry to accept the same and to realise the amount of Rs.60 lakhs. On the said amount being realised, the Registry shall transfer the amount of Rs.60 lakhs deposited with it directly to the account of the Respondent; details of the account are as under:- Beneficiary Name: Sanghi Bros (Indore) Pvt. Consequently, after depositing the amount of Rs.60 lakhs against the amount of Rs.1,20,93,145/- due today, the balance sum payable to the Respondent would be approximately Rs.60,93,145/-. The Applicant has prayed for extension of time to deposit the balance sum
until 15.12.2025, on the premise that the Applicant has applied and is sanctioned a loan from Kotak Mahindra Bank, Vasco Branch; the Letter of Sanction has been produced today on record. It is the submission of the Applicant on affidavit that the amount of Rs.6,25,00,000/- is likely to be disbursed before 15.12.2025, which would be partly utilised to repay the entire outstanding amount under the decree to the Respondent.

Considering that a substantial portion of the outstanding has now been cleared by the Applicant and the sum due and payable under the decree is approximately Rs.1,20,93,145/-, as claimed by the Respondent to be due till date, a case has been made out to extend time to deposit the balance amount subject to the calculation to be submitted by the Applicant on the next date of hearing. Consequently, the time to deposit the balance amount payable, as claimed by the Respondent, after depositing a deposit of Rs.60 lakhs deposited today, stands extended till 15.12.2025.
