After hearing the learned Advocates for the parties and considering the suggestions exchanged by the parties, I proceed to record the following consent order:
(a) The parties are present in the Court today i.e. the father and mother of Aakash; Aakash has Christmas holidays commencing from 23.12.2025 to 02.01.2026, after which school reopens on 03.01.2026. It has been agreed by his parents that Aakash will stay
on 23.12.2025 and 24.12.2025 with his father and return to his mother on 24.12.2025 at around 7.30 p.m.; he would spend Christmas Eve night and Christmas lunch with his mother and return to his father at 6.00 p.m. on that day. Thereafter, he shall spend the rest of the day of 25.12.2025 until 26.12.2025 till 5.00 p.m. with his father, and return to his mother for remainder of 26.12.2025 until 28.12.2025; he shall return to his father at 4.00 p.m. on the evening of 28.12.2025.
(b) Aakash shall spend time with his father for the remainder of 28.12.2025 until the evening of 01.01.2026 and return to his mother at 5.00 p.m. on that day.

The other arrangements under the order dated 17.10.2025 shall continue between the parties as under:
(a) During his stay with his father, Aakash shall have a daily video call with his mother at any time that is convenient to him and his mother, considering the activities that he takes part in, during the course of the week. Solano, to ensure that Aakash spends at least half an hour in conversation on a daily basis with his mother. (b) Valerie has placed on record Aakash's entire schedule from
Monday to Friday, which consists of various sports activities and music classes. Details of the timings of these activities are stated in the chart, which is placed on record. Solano shall ensure that Aakash attends all these activities, adhering strictly to their timings, in addition to which he shall ensure that Aakash completes all homework, assignments and revisions for the upcoming examination, which are listed under the caption "school work". Details of the school work would be emailed by Valerie to Solano.
(c) Solano to ensure that unless Aakash is required to access the internet or complete any work on screen, apart from this access, Aakash shall not be allowed to spend time on any electronic gadgets. These directions have to be strictly adhered to, considering the effects these gadgets may have on Aakash during his stay with his father.

On the suggestions of the parties, the learned Civil Judge Senior Division, Merces, in charge of 'A' Court Smt. Sarika Faldessai N. Faldessai, Senior Civil Judge & Chief Judicial Magistrate, 'A' Court, Panaji is appointed as a Mediator who shall attempt mediation of
marital and custodial issues, subject matter of Matrimonial Petition No. 58/2021/B and Civil Miscellaneous Application No. 27/2022. The parties shall place a copy of this order before the Mediator and shall appear before the Mediator at such time/date fixed by the Mediator. They shall co-operate with the Mediator, who may also take assistance of a Counsellor, whom she may appoint to assist in interviewing the child considering of the best interest of the child. Reports of such appointed Counsellor may also be taken into consideration.
4. The Mediator may place a report of mediation process from time to time before this Court 5.
The present application stands disposed of.
