MARCH 12, 2026 1) The present application is filed seeking transfer of divorce petition bearing No.A-729/2024, from the file of Family Court No.2, Nagpur to the Family Court at Amravati. It is stated that applicant/wife is staying at Amravati and she has no source of income. As against this, the respondent/husband is residing at Nagpur and is in private service.
2) The parties are not blessed with issue from the said wedlock. The respondent/husband has states that it will be difficult for him to travel from Nagpur to Amravati since he is in private service. For travelling from Nagpur to Amravati he will have to obtain leave, which would cause financial loss. The husband has volunteered to pay an amount of Rs.1500/-per date to the wife towards travelling and other expenses. 3) The transfer application is filed at the stage when the matter was posted for evidence.
4) In view of the aforesaid, transfer application is rejected, since transferring the matter from Nagpur to Amravati KOLHE
2 03-mca 23.2026.odt will cause greater hardship to the husband and also having regard to the fact that the husband is willing to pay appropriate amount to the wife towards travelling and other expenses. The respondent/husband is directed to pay Rs.1500/- to appellant/wife on each date on which she personally appears in Family Court at Nagpur.
5) The learned Family Court at Nagpur is, however, requested to favourably consider the request of the wife to appear through video conferencing as and when possible. 6) Fees of the appointed counsel be determined and paid in accordance with rules.
