The applicant has filed this application to transfer the matter which is pending before the Civil Judge, Senior Division, Nagpur to Civil Judge, Senior Division, Gondia.

The learned counsel appearing for the applicant stated that, the applicant is staying with her sister alongwith her daughter who is two years of age. The Domestic Violence proceedings are pending before the Judicial Magistrate, First Class, Gondia. It is difficult for her to travel alongwith her daughter. Hence, prayed to transfer the matter from Civil Judge, Senior Division, Nagpur to Civil Judge, Senior Division, Gondia. 3.
The learned counsel appearing for nonapplicant has stated that, the non-applicant has filed the petition under Section 9 for restitution of conjugal rights. Now he is ready to stay with her. The mediation proceedings will be conducted if she appears before this Court. Hence, prayed to reject the application. Tanmay

The applicant is staying with her sister alongwith her daughter who is 2 years of age at Gondia. There is nobody to escort her and it is difficult for her to attend the Court alongwith her daughter.

Hence, the Misc. Civil Application is allowed. 7.
The petition which is pending before the Civil Judge, Senior Division, Nagpur is transferred to Civil Judge, Senior Division, Gondia.

The learned counsel appearing for applicant and non-applicant are appointed through legal aid and their fees shall be quantified as per rules.
