The applicant is staying at Wardha, she has filed this application to transfer the proceeding bearing Hindu Marriage Petition No.A- 42/2025 filed by the nonapplicant which is pending before the Family Court No. 9, Pune to the Civil Judge, Senior Division, Wardha. 2.

The learned counsel appearing for the applicant stated that, both applicant and non-applicant are from Wardha District. They stayed at Pune after their marriage. The applicant is not doing anything, due to differences, she came back to her parent's house. The applicant has filed an application under the provisions of the Domestic Violence Act, 2005. After said proceedings, the non-applicant has filed the divorce petition before the Family Court No. 9, Pune.

Though, the non-applicant is served, he is not present before this Court. As the applicant is staying at Wardha District, which is the native place of the nonapplicant also. The applicant has filed one Domestic Violence proceeding bearing P.W.D.V.A. Application No. Tanmay

56- MCA No. 102-2025 .odt 2/2 19/2024 which is pending before the Judicial Magistrate, First Class, Selu, District Wardha.

As he has to appear before the Judicial Magistrate, First Class, Selu in the said matter, it will be convenient for both of them to contest the matter before the Civil Judge, Senior Division, Wardha.

Hence, the proceedings bearing Hindu Marriage Petition No.A- 42/2025 pending before the Family Court No. 9, Pune is hereby transferred to the Civil Judge, Senior Division, Wardha.

The Misc. Civil Application is disposed of. No costs.
