In the present matter, this Court, by its judgment dated 17/10/2025, held that applicant is entitled to seek a fresh reference of the dispute to arbitration under Section 11(6) of the Arbitration and Conciliation Act, 1996. Accordingly, the prior arbitral award has been set aside and the arbitration clause was revived. 2.

In view of this order of this Court, and with the consent of both the parties, Mr. Sumant Y. Deopujari, learned advocate, is appointed as the Arbitrator in the matter.
