By this application, the applicant is seeking the transfer the Petition No.A-12/2025 pending on the file of Family Court, Bhandara, Dist. Bhandara, to Civil Judge Senior Division, Gondia, District Gondia.

The main submission of the present applicant is that the applicant will cause inconvenience of traveling from Gondia to Bhandara and, therefore, considering the inconvenience which is likely to be caused to the applicant, the proceeding is required to be transferred from Bhandara to Gondia.

Learned Counsel for non-applicant strongly objected the present application. According to the non-applicant, distance between Bhandara to Gondia is only 70 kms. According to him, now a days, the transportation is very much available for such a short distance and no inconvenience would be caused to the applicant. 5.
In the facts and circumstances, the judicial notice can be taken of the fact that Gondia and Bhandara is not a long distance and the applicant who is 30 years old lady can very well travel such a short distance.

However, if she is having any difficulty, she can accompany anyone from her family to attend the proceedings. In that event, at the most, non-applicant can be directed to pay the
mca 262-2025.doc 3/4 travelling charges to the applicant and if it is done, there will be no need to transfer the proceedings from Bhandara to Gondia. 7.
Learned Counsel for non-applicant fairly accepted that on each date, he is ready to pay Rs.1000/- to the applicant as and when she will appear physically before Family Court, Bhandara. Accepting this statement, I am of the opinion that the present application can be disposed of on the following terms and conditions. Hence, I proceed to pass the following order:
ORDER
i) The application is partly allowed.
ii) Non-applicant is directed to pay or deposit Rs.1000/- to applicant on the day of her physical attendance of proceeding before Family Court Bhandara.
iii) Family Court Bhandara is directed to decide the proceedings by granting fair and proper opportunity to both the parties. iv) Applicant is at liberty to attend the proceedings before the Family Court, Bhandara through video conferencing, but with a rider that she has to attend the proceedings physically as and when her physical attendance is necessary in the matter before the Family Court, Bhandara.
