The applicant has filed this application to transfer R.C.S. No. 25/2024, which is pending before the Civil Judge, Junior Division, Arni (Yavatmal) to Family Court, Akola.

It is mentioned in the application that the applicant is staying at Akola. She has filed proceedings under Section 125 of Code of Criminal Procedure for maintenance before the Family Court, Akola and she is appearing in said matter. Thus, the applicant has prayed to transfer the matter which is pending before Civil Judge, Junior Division, Arni (Yavatmal) to Family Court, Akola.

The learned counsel for non-applicant has stated that the non-applicant would like to settle the matter and requests for referring the matter for mediation at Nagpur. The applicant has refused to attend the mediation at Nagpur, as it is difficult for her to attend the mediation proceeding at Nagpur.

As the applicant has filed the proceedings under Section 125 for maintenance and is pending before the Family Court, Akola, the non-applicant has to attend the said proceedings at Akola. As such, if the matter which is pending before the Civil Judge, Junior Division, Arni (Yavatmal) is transferred to Family Court, Akola and the counseling would be done there, it will cause no prejudice to the non-applicant.

Hence, the Misc. Application is allowed. The matter which is pending before the Civil Judge, Junior Division, Arni (Yavatmal) is transferred to Family Court, Akola.
