DATE : 15.12.2025 This Court on 17.07.2025, issued notices to the non-applicant. The record shows that notice issued to the non-applicant was awaited and thereafter matter was listed before the Registrar on 11.11.2025, 01.12.2025 and 04.12.2025.

The record further shows that the applicant has served the copies to the Registry of this Court on 08.12.2025. As a result, the notice issued to the nonapplicant is awaited by regular mode. As such, it is clear that the applicant is not vigilant to serve the non-applicant. 3.

Today, after getting urgent circulation in the matter, the grievance is raised that learned Civil Judge Senior Division, Palghar is proceeding with the matter and, therefore, this Court should take note of the fact otherwise the present application will become infructuous.

In the circumstances, the applicant is permitted to serve non-applicant by all permissible private mode of service in addition to regular mode of service and file affidavit of the same on or before next date. 5.

In the meantime, if the applicant move the application for adjournment before learned Civil Judge Senior Division, Palghar, the same shall be considered positively by the Court.

List the matter on 06.01.2026.
