Mr. Nikhil Lapalikar, learned counsel for the respondents informed that the respondent has filed an application for appointment of Arbitrator in relation to the same agreement before the Principal Seat at Bombay. He also informs that an application under Section 9 of the Arbitration and Conciliation Act seeking interim measure is also filed at Bombay. He points out Clauses 14 and 15 of the Agreement and contends that the place of arbitration is at Mumbai and that the parties have restricted jurisdiction of courts at Mumbai for adjudication of dispute arising out of the agreement. His contention is that in view of Clause 14, the seat of arbitration is at Mumbai and, therefore, application ought to have been filed at Mumbai. 3.

In order to afford one opportunity to the applicant, stand over to 7.5.2026.
