JUDGMENT

1.

By this application, the applicant-wife is seeking the transfer of the proceeding bearing Petition No.A-940/2024 filed by the non-applicant-husband before the Family Court, Nagpur to the Family Court, Amravati.

In this matter the non-applicant is duly served by private mode of service as well as regular mode. However, he choose to remain absent in the present matter. 3.

The applicant came with a specific submission that out of the wedlock they have begotten one child namely, Viraj. The said child is facing the disability in relation to central nervous system and according to medical certificate he is having 90% permanent disability. As such, it is not possible for the applicant to left alone the child at home or to travel with him from Amravati to Nagpur.

The averments made by the applicant are remain uncontroverted due to non-appearance of non-applicant in the matter. The inconvenience which she will face is apparent in the matter. Hence, this court is satisfied that the reason put-

3 75 MCA 439.25 forth by the applicant is justified to transfer the proceeding. Hence, I proceed to pass the following order :

O R D E R

(1) The application is allowed.

(2) The proceeding of Petition No.A-940/2024 is hereby transferred from the Family Court, Nagpur to the Family Court, Amravati.

(3) The Family Court, Nagpur is requested to transfer the record and proceeding to the Family Court, Amravati. (4) Applicant and Non-Applicant to appear before Family Court on 23.3.2026.
