This is an application seeking transfer of divorce petition bearing M.P. No.301 of 2025 from the file of the learned 3rd Joint Civil Judge Senior Division, Vasai, Dist. Palghar to Family Court, Akola.

The applicant/wife is aged about 47 years, who is residing with son who is around 17 years of age and her mother who is 73 years old. The applicant/wife is working as a teacher in a private school. It is stated that the mother is suffering from various ailments and is bed ridden. The nonapplicant/husband residing at Vasai. He is businessman residing in a joint family.

Distance between Vasai to Akola is around 575 Kms. The applicant has to take care of her old mother, take care of her household choices and also attend the school. As against this, the non-applicant is a businessman living in a joint family.

Having regard to the totality of circumstances, in the considered opinion of this Court, it will be expedient that M.P. No.301 of 2025 be transferred from the file of the learned 3rd Joint Civil Judge Senior Division, Vasai, Dist. Palghar to the Family Court, Akola.

In the event, the non-applicant/husband makes a request for appearance through video conferencing, the learned Family Court shall consider the same and permit him to appear through video conferencing as and when possible.
