ORAL JUDGMENT .
Heard Ms. Swati Kulkarni-Potey, learned Counsel for Applicant and Mr. Mangesh Raut, learned Counsel for Respondent. 2.
By this Application, the Applicant is seeking transfer of the proceeding bearing Petition No. A-84/2025 pending on the file of Family Court, Yavatmal to the Family Court, Amravati. 3.
It is the submission of the present Applicant that she has already
2/3 67.Judg.mca.562.2025.odt filed the proceeding bearing D. V. Application No. 116/2025 under the provisions of Protection of Women From Domestic Violence Act and the same is pending before the Chief Judicial Magistrate, Amravati. The Respondent is already attending the said proceeding at Amravati. Hence, according to the Applicant, if the proceeding, which is filed by the Respondent at Yavatmal is transferred at Amravati, no prejudice would be caused to the Respondent in the matter.

The learned Counsel for Respondent has strongly opposed this Application. It is stated that the proceeding arising out of the provisions of Protection of Women From Domestic Violence Act and the proceeding for divorce are altogether different proceedings, and therefore, they are not interdependable to each other. So also it is pointed out by the learned Counsel that distance between Amravati to Yavatmal is only about 90-100 kms. and public transportation is very much available to the Applicant to attend the proceeding at Yavatmal. It is further stated that Respondent is ready to pay travelling charges to the Applicant.

In view of above submissions made by the learned Counsel for both sides, in my opinion, following order will subserve the justice in the matter.

ORDER
1. Misc. Civil Application is partly allowed.
2. The Applicant is permitted to appear through Video Conferencing before the Family Court, Yavatmal on the dates when her physical attendance is not necessary before the Family Court, Yavatmal.
3. The Respondent is directed to deposit Rs.1000/- on or before each date fixed before the Family Court, Yavatmal towards travelling charges in the bank account or by any mode of payment, permissible or acceptable by the Applicant.
4. No order as to costs.
