By this application, the applicant prays for transfer of Petition No.A-103/2024 from the file of Family Court, Buldhana to the Court of learned Civil Judge, Senior Division, Washim.

The distance between Buldhana and Washim is around 125 kilometers. The learned Advocate for the applicant/wife states that there is a proceeding filed under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 125 of the Code of Criminal Procedure), which is pending before the learned Judicial Magistrate First Class, Washim being Criminal Misc. Application No.48/2025. The learned Advocate contends that applicant/wife does not have any independent source of income and is staying with her aged parents at her parental house at Washim and therefore, proceeding should be ordered to be transferred from Buldhana to Washim.

On the other hand, learned Advocate for the respondent/husband contends that the applicant/wife has entered appearance in the divorce petition on 16/11/2024 and the present transfer application is filed in the first week of August, 2025. Learned Advocate has produced copy of order-sheet in the divorce petition for perusal of this Court. 4.

Perusal of order-sheet will demonstrate that the applicant/husband has filed evidence closing Pursis on 23/07/2025 and evidence of the non-applicant/wife was closed on 05/08/2025. The case was posted for final arguments on 26/08/2025. However, the matter could not proceed, in view of interim order dated 25/08/2025, passed by this Court, granting stay to further proceedings. 5.

Having regard to the stage at which the present application is filed i.e. stage of final arguments, this Court is not inclined to allow the application. Misc. Civil Application is, therefore, rejected.

In the event the applicant/wife files application, seeking permission to conduct cross-examination of the non-applicant/husband and seeks permission to lead evidence, the same may be considered sympathetically having regard to the fact that the dispute between the parties is a matrimonial dispute.

In the event, the applicant/wife makes an application for appearance through Video-Conferencing, the

same may be considered favourably and permission to appear through Video-Conferencing may be granted on such dates and at such stages, as is deemed appropriate by the learned Family Court, Buldhana.
