This Court, vide order dated 15/10/2025 referred the matter before Mediator. Mediator's report dated 8/12/2025 shows that in four meetings held at Mediation Center, none appeared before him. Hence, this matter was sent back to this Court. 2.

In the present matter, it is submitted by the Applicant that they were separated in the year 2012, however, after a period of 13 years, the Petition was filed by the Non-applicant before the Family Court Akola seeking declaration of nullity of marriage, wherein it is alleged that at the time of marriage with the Nonapplicant, the Applicant did not disclose the fact of her previous marriage with another person, and therefore, he is seeking nullity of marriage in the said proceeding.

The learned Counsel for Non-applicant states that considering the reasons stated in the divorce petition, it is clear

2/2 17.mca.570.2025.odt that now he is not wiling to cohabit with the present Applicant. It is alleged by him that Applicant has performed remarriage. 4.

In the background of abovesaid factual position, I am of the pinion that one more opportunity can be given to the parties to settle the matter amicably before the Mediator. Accordingly, by consent of both the parties, Advocate Mr. Samir S. Das is appointed as Mediator in the matter.

Parties are directed to appear before the Mediator on 12/1/2026.

It is made clear that if the parties remained absent before the Mediator on the given date, this Court will not further consider their submission and will decide the present Application on its own merits.

The Mediator is requested to submit his report within a period of three weeks from appearance of the parties before him. 8.
