By this Application, the Applicant is seeking transfer of HMP No. A-261/2024 filed by the Respondent, pending before the Family Court, Nagpur to Family Court, Amravati. 3.

It is the submission of the Applicant that one proceeding filed by her bearing Misc. Criminal Application No. 132/2024 under the provisions of Protection of Women from Domestic Violence Act is already pending at Amravati and Respondent is attending the same. However, as a counter-blast to the said proceeding, the Petition bearing HMP No.261/2024 for dissolution of marriage has been filed by the Respondent before the Family Court, Nagpur.

Hence, issue notice to the Respondent, returnable in three weeks.

In the meantime, there shall be ad-interim stay in terms of prayer clause -(ii) of the Application. 6.

In addition to regular mode of service, the Applicant is at liberty to serve the Respondent by all modes of private service, as permissible in Rules and file affidavit of service on or before the next date, failing which, the order of interim relief will be recalled.
