By present application, Applicant-wife is praying to transfer the proceeding from Nagpur to Yavatmal. 2.

It is stated that the applicant-wife has filed the proceeding before the Family Court, Yavatmal for maintenance, same was allowed by judgment dated 10.11.2022. However, as non-applicant is not paying the regular maintenance, application under Section 125 (3) of the Code of Criminal Procedure is now pending on the file of Family Court, Yavatmal. 3.

It is further informed that the non-applicant has moved application for alteration of maintenance amount at Yavatmal.

In view of above, issue notice to the non-applicant, returnable after four weeks.

In the meantime, there shall be stay in terms of prayer clause (iii), till next date.
