The learned Counsel appearing for Applicant vehemently argued that the proceedings bearing HMP No.55/2025 filed by the Non-applicant/husband at Civil Judge Senior Division, Akola for declaration of marriage and annulment of marriage is nothing but a counter-blast to the Application under Section 144 of the Bhartiya Nagarik Suraksha Sanhita, 2023, which was filed by the Applicant/wife before the Judicial Magistrate First Class, Mehkar. According to the learned Counsel, Misc. Criminal Case No. 139/2025 and Regular Criminal Case No. 141/2025 are pending before the Judicial Magistrate First Class, Mehkar. The Non-applicant is appearing in one of the proceeding at Mehkar. 3.
Issue notice to the Non-applicant, returnable after three weeks.

In the meantime, there shall be ad-interim stay in terms of prayer clause - (iii) of the Application. 5.
In addition to regular mode of service, the Applicant is permitted to serve the Non-applicant by all modes of private service, as permissible in Rules and file affidavit of service on or before the next date. Failure to file affidavit of service, ad-interim stay granted will be vacated automatically.
