By this application, the applicant is seeking the transfer of Divorce Petition No.A-153/2025 pending before the Family Court No.5 at Pune to the Family Court at Nagpur. 2.

The submission of the applicant is that she has already filed the proceeding under the Protection of Women from Domestic Violence Act, 2005 and same is registered before the learned Joint Civil Judge, Senior Division at Nagpur as Misc. Application No.5461/2024. Hence, as a counter blast, the nonapplicant has filed the proceeding at Pune. 3.

Hence, issue notice to the non-applicant, returnable after four weeks.

In the meantime, there shall be interim relief in terms of prayer clause (ii) of this application.

Applicant to serve the non-applicant by all permissible modes of service in addition to the regular mode of service and file affidavit of service on or before the next date. Failure to file the affidavit interim order granted by this court will be automatically vacated.
