MARCH 25, 2026 1) This is an application seeking transfer of Petition No.A-149/2023 from the file of Family Court, Akola to Family Court at Pune. The applicant-wife is staying at Pune. She is in private employment. The respondent-husband is also in private employment at Akola. The proceeding is at the stage of evidence. The applicant-wife is attending the proceeding at Akola regularly, as can be seen from the order-sheet produced on record by the respondent-husband. The parties do not have any issue from the wedlock. The applicant-wife is around 31 years of age. She is staying alone and is an independent working woman.
2) Although a proceeding under Protection of Women from Domestic Violence Act, 2005 bearing Criminal Complaint No.238/2024 and a criminal prosecution under Section 498-A of Indian Penal Code vide R.C.C.No.3762/2023, pending at Pune, the proceeding for divorce is filed prior to institution of domestic violence case. The husband has volunteered to pay travelling KOLHE
2 04-mca 733.2025.odt expenses @Rs.5000/-p.m. as and when the wife attends the proceeding at Akola by remaining present in person. 3) In view of the aforesaid, application for transfer of petition is rejected.
4) In the event the applicant-wife makes an application for appearance through video-conferencing, the same may be considered favourably and permission to appear through videoconferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Family Court, Akola.
