It is informed that the applicant has already filed the proceedings under the Protection of Domestic Violence Act and same is pending before the JMFC, Khamgaon. He further stated that the applicant is having a child of 18 months old only and, therefore, seeks transfer the proceedings from Pusad to Khangaon.

Hence, issue notice to the non-applicant, returnable after four weeks.

In the meantime, there shall be stay in terms of prayer clause (3) of this application.

Applicant to serve the non-applicant by all permissible modes of service in addition to the regular mode of service and file an affidavit of service on or before the next date. 5.

Failure to file affidavit of service, interim relief granted shall stand vacated.
