By this Application, the Appellant is seeking restoration of First Appeal No 180/2017, which was dismissed by this Court vide order dated 9/7/2025.

In view of the averments made in paragraph Nos.4 and 5 of the Application, which are not controverted in the matter, Misc. Civil Application is allowed.

The order dated 9/7/2025 is recalled and First Appeal No. 180/2017 is restored on its file at original stage. 4.

The learned Counsel Appellant states that he will deposit the deficit court-fees with the Registry of this Court within a period of one week from today. Statement is accepted.
