By this application, the applicant is seeking transfer of Marriage Petition No.25/2025 pending on the file of District Judge, Thane to the Family Court at Nagpur.

The contention raised by the applicant is that she has already filed the proceeding before the Family Court at Nagpur under Section 144 of the BNSS for grant of maintenance. The non-applicant is appearing in the said proceeding at Nagpur. The other ground raised by the applicant is that the distance between Nagpur to Thane is near about 700 km. Accordingly, the submission of the applicant that only to harass the present applicant, the non-applicant has filed the proceeding of Restitution of Conjugal Rights at Thane.
Hence, issue notice to the non-applicant returnable after two weeks.

In the meantime, thsere shall be ad-interim stay in terms of prayer clause (iii).

Applicant is permitted to serve the non-applicant by all permissible mode of service in addition to regular mode of service and file an affidavit of service within a period of two
