By this Application, the Applicant/wife is seeking transfer of proceeding bearing Petition No. A-867/2021 pending on the file of Family Court, Nagpur to Family Court, Pune. 3.

In the present matter transfer of proceeding is sought only on the ground that presently the Applicant being appointed as Assistant Professor in Pathology Department at Yashwantrao Chavan Memorial Hospital, Pimpri Chinchwad, Pune, the proceeding filed against her be transferred to the Family Court, Pune.

Considering the fact that nature of proceeding is of restitution of conjugal rights and Applicant is serving at a distance more than 650 kms., it is not possible for her to attend the proceeding at Nagpur. It is also pointed out from the Roznama that

2/2 901.mca.799.2025.odt proceedings which are pending before the Family Court, Nagpur are listed for leading evidence of the parties on 12/11/2025. 5.

In view of above, issue notice to the Non-applicant, returnable after four weeks.

In the meantime, there shall be stay in terms of prayer clause - (B) of the Application.

In addition to regular mode of service, the Applicant is permitted to serve the Non-applicant by all modes of private service, as permissible in Rules, and file affidavit of service on or before the next date, failing which, the stay granted will be vacated automatically.
