The applicant/wife has filed the present application seeking transfer of HMP Petition No.A-900 of 2025 from the file of learned Principal Judge Family Court, Nagpur to the file of learned Civil Judge, Senior Division, Warora.

The applicant/wife is residing at Warora. Admittedly, the respondent/husband stays at Tumsar. Both parties are medical practitioners. The learned Advocate for the applicant however, states that presently the applicant is presently pursuing further studies. 3.

The respondent/husband, who is residing at Tumsar, has filed the divorce petition at Nagpur. In order to contest divorce petition he will have to travel from Tumsar to Nagpur. As against this, the applicant/wife is staying at Warora.

The parties have levelled allegations against each other with respect to physical assault and threats. 5.

Learned advocate for the respondent/husband draws attention to an application dated 24.03.2025 filed by him before the Court of Judicial Magistrate, First Class, Warora where he has stated that on 24.03.2025 the father of the applicant had provoked the applicant and applicant had assaulted him. The learned Court has not passed any order in that regard and the allegation is not yet proved.

It will be pertinent to record that 7 days before this, the applicant/wife had lodged a police complaint against the husband.

Having regard to the fact that the wife is residing at Warora and the husband is not residing at Nagpur, it will be appropriate to transfer HMP Petition No.A-900 of 2025 from the file of learned Principal Judge Family Court, Nagpur to the file of learned Civil Judge, Senior Division, Warora.

In the event the respondent/husband makes an application for appearance through video-conferencing, the same may be considered favorably and permission to appear through video-conferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Family Court.

In the event, any unfortunate incident occurs in future, it will be open for the husband to take recourse to appropriate proceedings of law as also to seek transfer of the proceeding from Court at Warora.
