It is stated that the applicant is having a minor child of two years and six months old. It is also stated that she has already filed the proceeding under the Protection of Women from Domestic Violence Act at Pusad. According to her, the distance between Pusad and Wardha is near about 180 km. Hence, it is not possible for the applicant to attend the proceeding at Wardha.

Issue notice to the non-applicant, returnable after four weeks.

In the meantime, there shall be ad-interim relief in terms of prayer clause (ii).

Applicant is permitted to serve the non-applicant by all permissible mode of service in addition to regular mode of service and file an affidavit of service within a period of four weeks, failing which, interim stay granted will stand vacated automatically.
