In the application under Section 11 of the Arbitration and Conciliation Act, 1996 (in short hereinafter referred as 'Act, 1996'), the respondent has entered appearance in view of the recall of exparte order dated 12.12.2025. Learned counel for the respondent, on instructions, submits that the Municipal Corporation, Amravati has no objection to the appointment of Arbitrator.

Pursuant to the earlier order, appointing the Arbitrator and calling the Arbitrator to submit disclosure under Section 12 of the Act, 1996, communication dated 14.01.2026 has been received from the learned Arbitrator expressing inability to conduct the arbitration proceedings on account of health issue.

Learned counsel for both the parties submit that they shall suggest the name of suitable
person to be appointed as Arbitrator by mutual consensus.

List the matters for further consideration on 02.02.2026.
