MARCH 25, 2026 1) The applicant-wife has filed the present application seeking transfer of petition bearing No.A-142/2025 from the file of learned Family Court at Jalgaon to learned Family Court at Nagpur. The applicant-wife is aged around 37 years. The respondent-husband is staying at Jalgaon. Custody of both minor children is with the respondent-husband. 2) In view of the aforesaid, in the considered opinion of this Court, it will be inconvenient not only to the respondenthusband, but also to the minor children, if husband has to travel from Jalgaon to Nagpur for attending the restitution petition. The applicant-wife has no such domestic responsibility. 3) In view of the aforesaid, transfer application is rejected.

4) It will be necessary to direct payment of some amount in order to enable the applicant-wife to travel from Nagpur to Jalgaon. Learned counsel for the respondent states that the respondent-husband is working in a private school and is earning KOLHE

2 05-mca 840.2025.odt salary of Rs.12000/-p.m. Learned counsel for the applicant-wife states that the income of the respondent-husband is around Rs.20000 to 25000/- p.m.

5) Having regard to the aforesaid, in the considered opinion of this Court, it will be expedient to direct the respondent-husband to pay sum of Rs.1000/- to the respondentwife for such dates on which, she physically attends the Court proceeding at Jalgaon.

6) In the event the applicant-wife makes an application for appearance through video-conferencing, the same may be considered favourably and permission to appear through videoconferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Family Court, Jalgaon. 7) Fees of appointed counsel be paid in accordance with the schedule.
