MARCH 25, 2026 1) The applicant-wife has filed the present application seeking transfer of Hindu Marriage Petition bearing No.164/2025 from the file of learned Family Court at Amravati to learned Civil Judge Senior Division, Wardha. The applicantwife is staying at Wardha. The respondent-husband is staying at Amravati along with a son, who is around 16 years of age. The applicant is a housewife and respondent is in private employment drawing salary of around Rs.15000 to 17000/- per month.
2) Having regard to the fact that applicant is a housewife and husband who is working in private establishment, will have to take leave in order to attend proceeding at Wardha, which will cause financial loss to him. In the considered opinion of this Court, no case is made out for transfer of proceeding from Amravati to Wardha. The distance between two town is hardly around 120 k.m.
3) Having regard to the fact that the applicant-wife does not have any source of income, the respondent-husband is KOLHE
2 06-mca 851.2025.odt directed to pay amount of Rs.500/- on each date to the wife when she attends the proceeding personally before the Family Court at Amravati.
4) In view of the aforesaid, transfer application is rejected.
5) In the event the applicant-wife makes an application for appearance through video-conferencing, the same may be considered favourably and permission to appear through videoconferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Family Court, Amravati. 6) Fees of appointed counsel be paid in accordance with the schedule.
