JUDGMENT

By this application, the applicant is seeking the transfer of Petition No.A-12/2025 pending on the file of the Civil Judge, Senior Division, Katol, District-Nagpur to the file of Civil Judge, Senior Division, Wardha, District-Wardha.

In this matter, this court has issued the notices on the non-applicant. The notice is duly served, but he chooses not to appear in the matter. The record depicts the fact that several opportunities has been granted to the non-applicant, so that he can attend the present proceeding, but he till date, did not appear in the matter. Hence, this court constrained to proceed to decide the present application on its own merits. 3.
It is submitted by the present applicant that she is residing at Pulgaon. There is no public transport available directly from Pulgaon to Katol to attend the proceeding. According to the applicant, she has to first reach at Wardha and then Katol. As such, she caused inconvenience for attending the proceeding at Katol.

It is further stated that she is having 12 years old daughter and there is no one in her family to look after the daughter. As such, considering the fact that his daughter is a school going, it is not possible for her to attend the proceeding at Katol by leaving alone the daughter at Pulgaon.

It is further pointed out that the non-applicant is bank employee and he is financially sound person. He can attend the proceeding before the Family Court, Wardha either reaching by his car or through video conference. Hence, considering this aspect of the matter, the indulgence of this court is necessary. 6.
In the present case, all the averments made on affidavit are not controverted and, therefore, considering the averments made in the application, it is clear that the applicant is causing great inconvenience to attend the proceeding at Katol. Hence, considering the factual aspect of the matter, I proceed to pass the following order :
O R D E R
(1) The application is allowed.
(2) The proceeding of Petition No.A-12/2025 is hereby transferred from the Court of Civil Judge, Senior Division, Katol, District-Nagpur to the Court of Civil Judge, Senior Division, Wardha, District-Wardha.
(3) The learned Civil Judge, Senior Division, Katol is requested to transfer the record and proceedings to the court of Civil Judge, Senior Division, Wardha.
4 67 MCA 856.25 (4) The learned Civil Judge, Senior Division, Wardha, after transfer of the proceeding, is directed to allow the nonapplicant to attend the proceeding through video conference on the dates when his physical attendance is not necessary before the court.
