DATE : 04/05/2026 1.
The present application is filed, seeking transfer of Marriage Petition No.1303/2025 from the Court of learned Civil Judge, Senior Division, Kalyan to Family Court at Nagpur. 2.
The only ground on which the transfer is sought is that the wife is staying at Nagpur and presently, she is not working and as such, she does not have the means to travel from Nagpur to Kalyan. It is also stated that the applicant-wife is staying with her old parents and therefore, there is nobody to accompany her for travelling from Nagpur to Kalyan. As against this, the respondent-husband is working as a Doctor. 3.
The hardship that the wife is likely to suffer can be taken care of by directing the respondent-husband to pay appropriate amount towards travel from Nagpur to Kalyan and for other expenses like stay etc. Asking the respondenthusband to travel from Kalyan to Nagpur will cause professional loss to the husband. There is good connectivity by train between Kalyan to Nagpur.
19. MCA 878 of 2025.odt 4.
In view of the aforesaid, Misc. Civil Application is rejected. It is, however, directed that as and when the applicant-wife attends the proceeding before the Court at Kalyan in-person, the respondent-husband shall pay a sum of Rs.10,000/- to the applicant-wife.
5.
In the event the applicant-wife makes an application for appearance through Video-Conferencing, the same may be considered favourably and permission to appear through Video-Conferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Civil Judge, Senior Division, Kalyan.
6.
No order as to costs.
