MARCH 23, 2026 1) This is an application filed under Section 24 of the Code of Civil Procedure seeking transfer of petition bearing No.A-74/2024 which is filed by respondent-husband seeking declaration of nullity of marriage, from the file of Family Court at Buldhana to the Court of Civil Judge Senior Division, Achalpur, District Amravati.
2) The children of the parties who are presently aged around 6 and 4 years are residing with applicant-wife. The distance between Achalpur and Buldhana is around 170 k.m. Having regard to the fact that minor children are residing with the wife, it will be difficult for the wife to travel from Achalpur to Buldhana to contest the proceeding.
3) In view of the aforesaid, the application is allowed in the following terms :-
(1) The petition bearing No.A-74/2024 is directed to be transferred from Family Court, Buldhana to the Court of Civil Judge Senior Division, Achalpur, District Amravati. KOLHE
2 15-mca 880.2025.odt (2) In the event the respondent/husband makes an application for appearance through video-conferencing, the same may be considered favourably and permission to appear through video-conferencing may be granted on such dates and at such stages as is deemed appropriate by the learned Court of Civil Judge, Senior Division, Achalpur, District Amravati.
