By this Application, the Applicant is seeking transfer of Hindu Marriage Petition No. 38/2025 pending on the file of Joint Civil Judge Senior Division, Bhandara to Civil Judge Senior Division, Gadchiroli.

The ground raised by the Applicant is that she has already filed two proceedings at Gadchiroli, one is for restitution of conjugal rights and second is the application under the provisions of Protection of Women From Domestic Violence Act. It is also pointed out that the Respondent is already attending the proceeding at Gadchiroli.

Hence, issue notice to the Respondent, returnable after four weeks.

In the meantime, there shall be stay in terms of prayer clause - (ii) of the Application.

In addition to regular mode of service, the Applicant is permitted to serve the Respondent by all modes of private service, as permissible in Rules, and file affidavit of service on or before the next date, failing which, the interim stay granted earlier will be vacated automatically.
