Learned advocate for the appellant states that the petition seeking divorce on the ground of desertion was dismissed on the ground that the same was filed prior to completion of 2 years from the date of desertion. He further states that he has instructions to withdraw the appeal, with liberty to file a fresh petition for divorce on the ground of desertion.

In view of the aforesaid, the appeal is disposed of as withdrawn, with liberty as prayed.
