Appellant - Ramdas Govind Awate, respondent no.1 Prakash Eknath Kate and respondent no.2 - Jaki Ahemad Abdul Gafar are present in-person today. They are duly identified by their respective counsels. They submit that the dispute between them has been settled amicably. The parties admit execution of the Settlement Deed dated 27.06.2025 and the terms and conditions contained therein. They have also filed their affidavits in this respect. A copy of the Settlement Deed is filed on record along with Compromise Pursis dated 05.08.2025 which is duly signed by the appellant, respondent nos.1 and 2 and their respective counsels.

In view of the above, the Second Appeal stands disposed of in terms of the compromise deed dated 27.06.2025.

The decree passed by the learned trial Court and confirmed by the learned First Appellate Court is hereby modified in terms of the settlement agreement. Decree be drawn up accordingly.
