The petition challenges the election of respondent No. 3 on the grounds that, in the speeches an appeal was made to the voters on the ground of religion and secondly, that to attract the voters utensils were distributed when the model code of conduct was in force. It is alleged that, this amounts to violation of Section 123 (1) and 123 (3) of the Representation of the Peoples Act.
