This Election Petition is filed mainly on three grounds that, at the time of contesting the election and filling up nomination, respondent No.1 - candidate was holding post as Administrator to the Agricultural Produce Market Committee, Jalna - an office of profit. This is against Article 191 of the Constitution of India. Second ground raised is that the nomination form of respondent No.1 was not complete in all respects. He had not disclosed criminal cases pending against him to the political party which had set up him as candidate. Third ground raised is that Form No.26 filled in by respondent No.1 was the Form as of 2014. Subsequently, there are changes made in the Form in the year 2017 and

( 2 ) ep3.25 2019. Another ground raised is that there is discrepancy in the number of Electronic Voting Machines those were used and those were counted. 03.

Considering the above, case is made out to issue notice to the respondent.
