Petitioner's challenge is to order dated 30-09-2025 passed by respondent no.1/Additional Commissioner, Nagpur in proceedings of Appeal under Section 16(2) of the Maharashtra Village Panchayats Act,1959 (for short, 'the said Act').

It is pointed out that by the impugned order, respondent no.1 has remanded the matter to respondent no.2 for fresh consideration. The contentions canvassed by the petitioner on merits about disqualification of respondent no.5 under Section 14(1)(j-3) of the Act could be agitated before the respondent no.2. On perusal of the impugned order it appears that the matter is simply remanded to be decided afresh after considering the factual and legal aspects. Learned Counsel for the petitioner has failed to demonstrate any perversity with the impugned order and hence no indulgence is warranted under Article 227 of the Constitution of India.

However, in view of the fact that this was a second round of litigation, it is directed that respondent no.2 should decide the proceedings under Section 14(1)(j-3) of the Act expeditiously and

In view of this, writ petition is disposed of. No order as to costs.
