The petition prays for a direction to the respondent authorities to pay the pensionary benefits of the Late husband of the petitioner, along with arrears and regular family pension. 3.

As can be seen from the facts stated in the petition that the husband of the petitioner was in the services of the respondent, Zilla Parishad, Akola, and was working on the post of Gramsevak (Secretary). On 30.04.2022, the said husband of the petitioner superannuated, and he unfortunately expired on 15.05.2022 due to a brain stroke.

Thereafter, on 28.09.2022, the petitioner approached the respondents authorities to grant pensionary benefits of her husband and made representations in that regard to the authorities from time to time. However, the respondent authorities failed to take any action and stated that they had asked the Panchayat Samiti where the husband of the petitioner worked, for issuance of a No Dues Certificate. Thereafter, on 27.04.2023 and 20.10.2023, various representations were made, but they failed to evoke any response. Finally, on 17.07.2024, the respondent No.2 informed the petitioner that the concerned department, where the husband of

931 wp 97-2026.odt 3/3 the petitioner had worked, has been informed that no dues certificate shall be issued, and only thereafter, the proposal for grant of pensionary benefits can be submitted. 5.

When confronted, the learned Counsel for respondents makes a statement, on instructions, that the process of granting pensionary benefits in lieu of the death of the late husband of the petitioner is near completion and would be completed within four weeks. The statement is accepted as an undertaking to the Court. 6.

Learned Counsel for the petitioner submits that in view of the solemn statement made by the learned Counsel for the respondents at the bar, the petition may be disposed off. In that view of the matter, the petition is disposed of in view of the statement made by the learned Counsel for respondents as stated supra.
