The respondent No.1 has floated a tender for the procurement of hydraulic pumps for Wagon Tippler Drive in CHP. The tender provides for qualifying requirements viz. the bidder should have a minimum three years experience in design manufacture and supply of tender items. Similarly, Section IV of the material schedule annexed to the tender document contemplates the format for submitting make and technical specifications and the bidder is required to submit technical specifications and make and model no. of the hydraulic pumps Prity

Drawing support from the tender documents of respondent No.1, it is claimed that though the respondent No.2 has failed to submit the details as regards to the make and model no. offered by it and technical specifications, still he is declared as qualified. Apart from the above, it is claimed that the respondent No.2 lacks minimum three years experience.

Issue notice to the respondents, returnable on 21.01.2025.

Mr. Mohgaonkar, learned counsel waives notice on behalf of the respondent No.1.

The learned counsel appearing for the respondent No.1 submits that until further orders, the work order shall not be issued.
