Learned AGP Ms.Mrunal Naik waives service of notice for the respondents.

The present petition is filed inter alia seeking direction to the respondents to return back the original documents of the petitioner procured during the verification of the caste certificate of Ku.Ratnamala Natthuji Waindeshkar, sister of the petitioner. The petitioner claimed to belong to Bhope Nomadic Tribe B-Category.

The tribe claim of the father of the petitioner has been validated by the Divisional Caste Certificate Scrutiny Committee vide its order dated 22/05/2003. It is contention of the petitioner that during the course of the enquiry in respect of caste certificate issued by the office of SubKHUNTE

8-wp216.26.odt 2/2 Divisional Officer Bhandara to the sister of the petitioner namely Ku.Ratnamala Natthuji Waindeshkar, the petitioner was asked to submit originals of certain documents with the respondent No.1-Committee, for which the respondent No.2 issued an acknowledgment. In spite of request and representation, the original documents did not return by the respondents. In view thereof, the petition can be disposed of with a direction to the respondents to return the original documents to the petitioner.

In view of above, the petition is allowed.

Both the respondents are directed to return the original documents to the petitioner within a period of two weeks from today as per acknowledgment at Annexure-A to the petition.

The petition stands disposed of. No costs.
